What Is a Wrongful Death Claim?
To file a wrongful death lawsuit, the victim has to have died as a result of negligence on the part of the person to be sued. Wrongful death laws allow for the beneficiaries of the victim to be awarded monetary damages because of the negligence.
A wrongful death claim has to meet four criteria:
- the death of the victim was determined to be more than 50% the fault of another
- in addition to being at fault, the other person was negligent
- there are surviving beneficiaries or dependents
- monetary damages resulted from the victim’s death
